 These terms are the only conditions applicable to the use of this website, and they supersede all other conditions, except with the express prior written agreement of the vendor. By using this website, you agree to the following:

FORMATION OF THE CONTRACT:

 The information provided in these terms and the details on this website do not constitute a sale offer but rather an invitation to treat. A contract for the purchase of products will only be established between you and us once your order has been accepted. If we do not accept your order and payment has already been deducted from your account, a full refund will be issued.

To place an order, you need to follow the online shopping process and click the "Authorize Payment" button to submit the order. Upon receipt of your order, we will send you an email acknowledging its receipt (the "Order Confirmation"). Please note that the contract will be formed and confirmed only when we send you an email stating that the product has been dispatched (the "Shipment Confirmation").

The brand reserves the right to verify the authenticity of an order through phone calls or emails. In case of customer dissatisfaction, authenticity concerns, or lack of response regarding an order, the brand retains the right to cancel the order.

The contract will only cover products that have been confirmed for dispatch in the Shipment Confirmation. We are not obligated to supply any other products that may have been part of your order unless their dispatch has been confirmed in a separate shipment confirmation.

 

PRODUCT AVAILABILITY:

 All product orders are subject to availability. In the event of supply difficulties or when products are no longer in stock, we may provide you with information about substitute products of equal or higher quality and value which you can choose to order. If you do not wish to order substitute products, we will refund any payment made by you.

 

ORDER REFUSAL:

 We reserve the right to withdraw any products from this website, make changes to materials or content, or refuse to process an order after sending an order confirmation. This may occur in exceptional circumstances and is at our sole discretion.

We shall not be held liable to you or any third party for withdrawing a product from this website, whether sold or not, making changes to materials or content on this website, or refusing to process or accept an order after sending the order confirmation.

 

 YOUR RIGHT TO CANCEL:

 As a consumer, you have the right to cancel a contract before the dispatch of goods. You will be entitled to a full refund of the price paid for the products, following our Returns Policy. However, please note that the return of a gift/credit coupon will be subject to the conditions outlined in the Gift Card's terms of use.

To exercise your right to cancel, the products must be returned in the same condition as when you received them, including all instructions, documents, and wrappings. Products that are damaged, not in the original condition, or excessively worn beyond normal product opening will not be eligible for a refund. Therefore, it is important to take reasonable care of the product(s) while they are in your possession.

Please be aware that certain products are exempt from cancellation rights, including customized items and products with removed original wrappings.

It is advisable to handle the products with care during your possession, retaining the original boxes, instructions/documents, and wrappings whenever possible for the return process.

 

DELIVERY:

 Unless there are exceptional circumstances or availability issues (as stated in Clause 4), we will make every effort to fulfill your order by the delivery date specified in the Order Confirmation.

Possible reasons for delivery delays may include unforeseen circumstances or delivery areas outside of our network scope.

 

UNABLE TO DELIVER:

 If we are unable to deliver the goods after two attempted deliveries, our carrier will contact you using the provided telephone number. If no one receives the parcel at the given address, the parcel will be returned to the brand, and a refund will be issued for prepaid orders.

 

RISK AND TITLE:

 The products are at your risk from the moment of delivery.

Ownership of the products will only transfer to you upon our receipt of full payment for all amounts due, including delivery charges, or upon delivery itself (as defined in clause 7 above), whichever is later.

The brand follows a practice of sealed box packaging. If the packaging is found to be damaged, tampered with, open, or soiled, the customer has the option to refuse the parcel. In such cases, the brand must be notified in writing via our support@vestirio.com email. Upon refusal, the brand will arrange for the dispatch of new merchandise (if available in stock) or issue a refund to the customer. This policy applies to prepaid registered orders only.

Once the customer accepts the consignment by confirming its condition, the brand does not hold responsibility for the goods or their condition.

 

COUPONS AND VOUCHERS:

 The brand may choose to distribute promotional coupons and gift vouchers at its discretion. Users may be disqualified under certain terms for distributing coupons and vouchers.

During sale promotions or end-of-season sales, coupons and gift vouchers may be disabled. However, any coupons held by the user can be used once the sale promotion or end-of-season sale concludes.

The use of coupons and vouchers is governed by VESTIRIO and may be withdrawn at any time.

 

PRICE AND PAYMENT:

While we make efforts to ensure the accuracy of all prices displayed on our website, errors may occur. If we discover an error in the price of any product(s) you have ordered, we will inform you promptly and give you the option to confirm the order at the correct price or cancel it. If we are unable to reach you, the order will be considered canceled, and if you have already made payment, you will receive a full refund.

We are not obligated to sell the product(s) to you at the incorrect (lower) price, even if we have sent you an Order Confirmation, if the pricing error is an obvious typographical or mathematical inaccuracy that you could have reasonably identified.

The prices displayed on our website include taxes, and delivery costs are outlined in clause 7.

VESTIRIO assumes no responsibility for any disputes arising from transactions conducted by any third party using your account/email provided to the company or payments made by your credit card on behalf of any third party.

We reserve the right to decline bulk or high-value purchase orders and to modify price and availability information without notice.

Once you have completed your shopping, all the items you want to purchase will be added to your cart. To proceed, follow these steps:

Review and update your contact details, order information, delivery address, and billing address.
Enter your card details.
Click on "Authorize payment."
You have the option to make payment using any Indian cards. Additionally, you can choose to pay for all or part of your order using a gift card or credit voucher issued by VESTIRIO. The charge will be applied once we confirm your order.

By clicking on "Authorize Payment," you confirm that the card belongs to you or that you are the legitimate holder of the gift card or credit voucher.

Please note that card payments are subject to validation checks and authorization by your card issuer. If the required authorization is not received, we cannot be held liable for any delays or non-delivery.

 

LIABILITY AND DISCLAIMERS: 

Our liability for any product purchased through our website is strictly limited to the purchase price of that product.

Nothing in these terms will exclude or limit our liability in any way for:

Death or personal injury caused by our negligence;
Fraud or fraudulent misrepresentation;
Any matter for which it would be illegal or unlawful for us to exclude or limit our liability.
Subject to the above paragraph and to the maximum extent permitted by law, unless otherwise stated in these terms, we will not be liable for indirect losses that occur as a consequence of the main loss or damage, whether arising from tort (including negligence), breach of contract, or otherwise, even if foreseeable. Loss of anticipated savings;
Loss of data; and
Waste of management or office time.
Due to the open nature of this website and the potential for errors in the storage and transmission of digital information, we cannot guarantee the accuracy and security of information transmitted to or obtained from this website, unless expressly stated otherwise on the website.

Notice will be considered received and properly served immediately upon mailing to us, 24 hours after an email is sent, or three days after the date of posting a letter. To prove the service of any notice, it is sufficient to demonstrate that, in the case of a letter, it was properly addressed, stamped, and placed in the post, or in the case of an email, it was sent to the specified email address of the recipient.

 

TRANSFER OF RIGHTS AND OBLIGATIONS:

The contract between you and us is binding on both parties and on our respective successors and assigns.

You may not transfer, assign, charge, or otherwise dispose of a contract, or any of your rights or obligations under it, without our prior written consent.

We reserve the right to transfer, assign, charge, subcontract, or otherwise dispose of a contract, or any of our rights or obligations under it, at any time during the term of the contract. However, such a transfer, assignment, charge, or disposition will not affect your statutory rights as a consumer, nor will it cancel, reduce, or limit any warranty or guarantee provided by us to you, whether express or implied.

 

EVENTS OUTSIDE OUR CONTROL:

We shall not be held liable or responsible for any failure or delay in performing our obligations under a contract if such failure or delay is caused by events beyond our reasonable control, referred to as a "Force Majeure Event."

A Force Majeure Event includes any act, event, omission, or accident that is beyond our reasonable control, including, but not limited to:

Government lockdowns
Strikes, lockouts, or other industrial actions
Civil commotion, riot, invasion, terrorist attack, or threat of terrorist attack
War (declared or not) or threat or preparation for war
Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disasters
Inability to use public or private transport, including railways, shipping, aircraft, motor transport, or other means
Inability to use public or private telecommunications networks
Acts, decrees, legislation, regulations, or restrictions imposed by any government
Shipping, postal, or other relevant transport strikes, failures, or accidents
During a Force Majeure Event, our performance under a contract will be suspended, and we will be granted an extension of time to fulfill our obligations for the duration of the event. We will make reasonable efforts to bring the Force Majeure Event to a close or find alternative solutions to fulfill our obligations under the contract despite the event.

 

SERVICEABILITY:

If any provision of these Terms or any provisions of a contract is deemed invalid, unlawful, or unenforceable by a competent authority, that specific term, condition, or provision will be severed to the extent necessary while the remaining terms, conditions, and provisions will remain valid to the fullest extent permitted by law.

 

ENTIRE AGREEMENT: 

These Terms, along with any documents expressly referred to in them, constitute the entire agreement between you and us regarding the subject matter of any contract. They supersede any prior agreements, understandings, or arrangements, whether oral or written, between you and us.

You and we acknowledge that, in entering into a contract, neither party has relied on any representations, undertakings, or promises made by the other party, whether orally or in writing, during negotiations prior to the contract, except as expressly stated in these Terms.

Neither party will have any remedy in respect of any untrue statement made by the other party, whether orally or in writing, prior to the date of the contract unless such untrue statement was made fraudulently. The only remedy available to the aggrieved party will be for breach of contract as provided in these Terms.

The following actions are deemed as misuse of the website and are strictly prohibited:

• Providing instructions or information about illegal activities, such as the production or purchase of illegal weapons, invasion of someone's privacy, or posting videos, photographs, or images of an individual aged 18 or older without their express written consent, or those of a minor, regardless of consent from the minor or their legal guardian.
• Engaging in any of the above actions is strictly prohibited and may result in legal consequences.

LAW AND JURISDICTION: 

Contracts for the purchase of products through our site are subject to the laws of India. Any disputes arising from or related to such contracts shall be resolved in the non-exclusive jurisdiction of the Surat courts. If you are a consumer, your statutory rights will not be affected by this clause.

This agreement is governed by the laws of India and shall be interpreted and construed in accordance with them. The place of jurisdiction for any legal matters shall be Surat Gujarat.
